These Terms form an agreement between you and FLUENT PATH LTD and apply when you visit, register for or use Hire Kenyan Talent. By creating an account or using the service you agree to them. Our Privacy Notice and Cookie Notice provide related information; additional terms may apply to paid features. Do not use the service if you do not accept these Terms.

2. About Hire Kenyan Talent
Hire Kenyan Talent is an online marketplace operated by FLUENT PATH LTD, trading as Hire Kenyan Talent, connecting Kenyan remote professionals with employers in the UK and internationally. Features may include profiles, jobs, applications, discovery, shortlists, saved profiles, invitations, messaging, subscriptions, verification, moderation and support.
3. Eligibility
You must be at least 18, have capacity to contract, use the platform lawfully, provide accurate information and not be prohibited from using it. Employer registrants must have authority to represent their organisation.
4. Registration and account security
Keep registration details accurate. You are responsible for activity under your account, password and authentication security, and must promptly report unauthorised access. Do not sell, transfer or share accounts. We may request further verification or restrict suspicious accounts.
5. Worker accounts and profiles
Workers must keep skills, experience, availability and preferences truthful and current; upload only authorised content; avoid impersonation, misleading claims and unnecessary sensitive data; and comply with tax, immigration, employment, contractor and business-registration obligations. Visibility follows the platform settings, and public-profile content may be indexed by search engines.
6. Employer and organisation accounts
Employers must identify themselves accurately, use candidate information only for genuine recruitment, protect CVs and applicant data, and comply with equality, anti-discrimination, employment, immigration, tax and worker-protection law. Do not scrape, sell or improperly disclose candidate data, request unlawful fees, require payment for employment, publish deceptive jobs or misuse identity documents.
7. Job listings
Listings must be genuine, current, lawful and clear about the role, location, working arrangement, status and compensation where provided. Fraud, pyramid schemes, illegal work, forced labour, trafficking, adult sexual services, advance-payment requests, hidden employers, exploitative commission-only roles and data-harvesting jobs are prohibited. We may reject, edit, pause, investigate or remove listings.
8. Applications, invitations and communications
The platform may facilitate applications, messages and notifications, but delivery is not guaranteed. Communicate professionally; harassment, threats, discrimination, spam and abuse are prohibited. Avoid sharing passwords, banking credentials or unnecessary identity documents. We may investigate reports where lawful but cannot monitor every interaction.
9. Agreements between workers and employers
Users decide whether to contract and should agree written terms covering pay, hours, deliverables, leave, benefits, notice, confidentiality and intellectual property. They determine the legal relationship and are responsible for tax, payroll, social security, pension, insurance and regulatory obligations. We are not liable merely because a party fails to perform.
10. Payments between workers and employers
Unless a separate payment service is expressly introduced, employers pay workers directly. We do not hold wages, guarantee payment or provide escrow. Use written agreements and secure payment methods; workers should never pay to obtain a job. Report suspected payment fraud.
11. Employer subscriptions and platform fees
Free and paid plans have the features and prices shown before purchase. Taxes may apply. Recurring billing occurs only where disclosed; payment providers may process payments and we may retain subscription and billing records. Cancellation controls are provided where available. A subscription does not guarantee applications, interviews or hires. Features and pricing may change with appropriate notice.
12. Cancellation and refunds
You may cancel recurring subscriptions through available controls. Cancellation normally prevents renewal at the end of the paid period. Statutory rights remain unaffected; refunds are assessed under applicable law, checkout information and the circumstances.
13. Verification
We may verify email, telephone, identity, organisation details, professional information, equipment, remote-working readiness or uploaded content. A badge means only that specified information was checked using the process available at that time; it is not an endorsement, warranty or guarantee. Users must conduct their own checks.
14. Reviews and feedback
Where review or feedback features are available, submissions must be truthful, based on genuine experience, non-defamatory, non-discriminatory and free from manipulation. We may remove fraudulent, abusive or irrelevant material.
15. Acceptable use
Do not use the platform unlawfully or fraudulently, impersonate others, harass or discriminate, scrape or bulk-extract data, create automated accounts, circumvent security, distribute malware or spam, infringe rights, reverse engineer where prohibited, disrupt availability, misuse candidate data, share accounts, or facilitate exploitation, trafficking or forced labour.
16. User content and licence
You retain ownership of CVs, photos, videos, portfolios and other uploads. You grant FLUENT PATH LTD a limited, non-exclusive licence to host, store, reproduce, format, display, transmit, moderate and make content available as reasonably necessary to operate, secure, improve and promote the service. Public content is displayed according to visibility settings. The licence ends on deletion, subject to backups, legal retention, dispute records and technical limitations.
17. Intellectual property
The Hire Kenyan Talent name, branding, software, design, documentation, original platform content, databases and compilation rights belong to FLUENT PATH LTD or its licensors. This does not transfer ownership of user content.
18. Moderation and reporting
We may review reports, request evidence, restrict visibility, remove content, suspend features or accounts, preserve evidence and refer suspected crime, fraud or abuse to authorities where lawful. We do not promise continuous monitoring.
19. Suspension, restriction and termination
We may act for breach, fraud, security threats, non-payment, repeated complaints, unlawful behaviour, harm, candidate-data misuse, legal requirements or platform protection. Account deletion has a 30-day recovery period before permanent deletion, subject to applicable exceptions and technical limitations.
20. Platform availability and changes
Continuous availability is not guaranteed. Maintenance, errors, outages and interruptions can occur; features and beta services may change or be withdrawn. We use reasonable care and may discontinue services with appropriate notice where practicable.
21. No guarantee of outcomes
We do not guarantee employment, candidates, applications, interviews, suitability, qualifications, every user statement, work quality, payment, immigration status, another user’s legal compliance or any particular feature.
22. Liability
Nothing excludes liability that cannot lawfully be excluded, including death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or removes consumer statutory rights. For business users, indirect or consequential losses are excluded where legally appropriate. No arbitrary liability cap applies.
23. Business-user indemnity
Business users are responsible, subject to applicable law, for losses arising from unlawful listings, their agreements, candidate-data misuse, employment-law breaches, intellectual-property infringement, fraudulent or misleading conduct, confidentiality breaches and unlawful recruitment practices.
24. Third-party services and links
Payment, cloud, email, verification and other third-party services and external links have their own terms and privacy practices. We are not responsible for services outside our control.
25. Changes to the Terms
We may update these Terms. Material changes will be communicated appropriately, and the revised effective date will appear on this page. Continued use after changes may constitute acceptance where lawful.
26. Governing law and jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales. Subject to mandatory rights that cannot lawfully be excluded, the courts of England and Wales have exclusive jurisdiction.
